Помогите советом в важном для меня вопросе. Я директор фирмы, которая занимается оказанием услуг в сфере компьютерных игр. Делаем все легально, с подписанием договоров. И вот один из наших новых клиентов подал в Арбитражный суд Москвы иск о взыскании с нас штрафных санкций за нарушение сроков, установленных договором. Но мы их не нарушили, с клиентом подписано допсоглашение о переносе сроков. Как быть в этой ситуации? Ничего не делать или лучше сходить в суд, какие мнения?
Rybilo, доброго Вам времени суток. Вот ничего не делать в судебном процессе нельзя. Ну вернее конечно можно, но этим Вы уж точно увеличите шансы истца получить неблагоприятное для вас решение суда. Напишите отзыв на исковое заявление, укажите что сроки по согласованию с истцом перенесите, приложите копию дополнительного соглашения. Если Вы не будете ничего делать, то как же судья узнает что сроки были перенесены? Конечно идите в суд, показывайте это дополнительное соглашение и выигрывайте процесс.
Ну игнор вызовов в суд может иметь последствием то, что вынесут штраф. Вроде бы у судей есть такая возможность, указать что имеет место неуважение к суду.
